What is the name of your state? CA. About 12 years ago, we purchased our first home for $89,000. Similar houses are now selling for close to $500,000. It is about 35 years old and a beautiful Jacaranda tree completely shades one side of the house. For some reason, the huge root system has "heaved-up" our foundation quite exstensively. It is just now that I have noticed not only recent settling, but signs of old repair work due to settling. My research shows that in some cases, homes like this are not only unsafe, but are of no value in this condition & must be demolished. My question is: Is this my fault for not knowing this could happen? Everyone has trees around here! My homeowners ins. does not cover this; should I sue the wealthy Real Estate Broker who sold us this house (she owned it) for not mentioning the root problem? or consult the property inspector we hired who found nothing wrong with the property? or was this just an unfortunate act of God? I'm sad because I know the previous owner knew about the problem when they replaced the carpeting for renters. We were counting on our equity for braces & college for 3 sweet girls & now I feel like we have absolutely nothing. How will we ever get rid of this place & who do I contact first before it collapses on us? (I'm very serious.) Where do I begin?

This problem has been developing over the last 12 years. It is common knowledge that as trees grow so do their roots. When you purchase a property, you take on the responsibility of the care and maintenance of that property.

Call in a tree expert to assess the tree and a structural engineer to assess the foundation damage. Most things CAN be fixed.

remove the tree, fix the foundation

dont look for someone to blame or sue for your problems you have been ignoring for years.

also how close to the hous is this tree?

the Jacaranda has a vigorous root system and is well known for causing structural damage, in lifting sidewalks, foundations, intruding in piping etc. you can find endless information on the internet. In addition several home network programs have featured damage done by invasive tree roots, yes, it is possible for the damage to be irrepairable, and to render your home inhabitable. There are several varieties of tree, that continue to grow roots and erupt from the soil with "suckers", even after the tree itself has been removed.

the tree is part of our landscape!

it doesn't matter now, as I have a terminal health problem. The tree will certainly outlive me! I am sooooo worried about my kids. I have not ignored nor neglected ANYTHING! My home is a showplace & I have spent the last 13 years dedicating my free time to maintaining & enjoying my lovely home. Now I need help for my poor husband who will eventually have to deal w/this. I am not trying to scam anyone. I have searched far & wide on the internet & no one has come close to the WONDERFUL advice all u special people have given to me************************************************************************************.....
