school accessing cell phone records

My son recently had his cell phone confiscated at school and an asst. principle and teacher go through his records on the phone. School policy prohibits use of the cell phones during class, which he was guilty of, but can they go thru his files/messages looking for information? State of Texas

I appreciate the candor, but still am unsure of how they can make the leap from having a cell phone to cheating on a test.

**A: why not simply ask your son. If he tells the truth, there's your answer.

I did ask my son. He emphatically denies the cheating, and his school history, grades, conduct support that. However, if they can do that and draw their own conclusions, besides appeal it, what can I do?

After you have your son leave his cell phone off during class and put it in a backpack or locker, tell your son to place a "power On" password on the phone and dont give them the battery next time. After all why would he have it out during class where the teacher would see it. Sometimes we pay the price for not thinking.
