school contacting parents of issues

What is the name of your state (only U.S. law)? Kansas
Around November of last year my 7 year old was caught in the bathroom with another student(mind you this is a kindergartener) doing sexual activity that has never happened in the past.(He was on his knees with his face in the privates of another student) The school knows he has been in counseling for the past year and they still insist on contacting srs before contacting me or his counselor outside of school so the situation can be taken care of immediately. Ever since then anything that happens, all fingers point to my son. They did nothing to the other child and mine was questioned by authorities. Was this fair? Now he has been having issues with other students since then. And he is now worried about going to the bathroom by himself, afraid he might have something done to him. Any suggetions of what to do? I have been trying everthing to protect him from the other students. He has been limited on when he goes to school because of all this and now i am getting close to having legal issues about truancy. But why would a parent want to have to keep going through this?:mad:What is the name of your state (only U.S. law)?

What was your child in counseling for initially? Was he sexually abused?

You ask about fairness to the other child - according to FERPA, they can't tell you anything about anything relating to another student. You should focus on your son only, not other children.

Does your child have an IEP? Could he use a restroom in the main office, like the nurse's office? Have you sat down and discussed options with the principal?

Why is your son refusing to go to school? If he is not ill, why are you allowing him to miss school? They will get you for truancy, so if this is truly as much of a problem as it appears to be, get him on a homeschooling regimen, or have him transferred to another school.
