What is the name of your state? GA

My husband just received info. from the school about one of his children. Is missing 37 days in one year substantial? And could it be relevant to a modification case?

He just started receiving info. from the school after pushing the issue.

I would say that is a pretty substantial amount of days to be missed.

What does mom say? Is there a VALID reason (illness) for these, or are they unexcused?

I n my state 10 abcenses unexcused is enough for the school system to call in cps and to take both parents and child to court for truency. Were there medical excuses for the absences and if not what has the school said about there plan of action ?, I am almost certain that 37 days is far beyond the norm and in my opinion neglectful unless there are good reasons such as medical problems.

That's like a day every week the child is in school. Of course, that's a lot. Did you miss school once a week?

i will ditto that ,but what we still do not know is if this child has something medical going on that causes the absences,I would like to get that clarified.

What is the reason for all the absent days?

My step children were in school in Georgia. My stepson had 31 unexcused absenses. 36(I think) total absenses 2/3 of the way into the school year. The school reported it. Stepson and mom ended up in juvenial court over the truancy issues. Mom was already under investigation by DFACS at that time. Reason for all the missed school days? Mom left the kids alone for days on end. Stepson set the alarm every morning, got little sister up and ready for school and put her on the bus. Then he went back to bed.

This was a big issue in my husband Georgia custody case. But for you, I would assume it would have to do with WHY the child missed so many days.

It doesn't really matter if the absences are medically-related or not. They are excessive -- period! Most districts (if not states) have guidelines (last I checked, which was a long time ago) that addresses excessive absences. The district could offer mandatory summer school to make up the time or the child faces being held back.

My husband just signed up for "Parent Connect" which is a program that you can check the status of the children. Last year the biomom canceled. For far she doesn't know about this year.

But the absences say 34 excused and 3 unverified absences. It doesn't say why she were excused just absent. She has not been deathly ill that he knows about, she had surgery over spring break. Other than that we don't know of anything else (Like she would tell him).

What is truancy?

Excused absences are generally for illnesses verified by a doctor, religious observances, etc. My kids generally flirt around 10 days absent, total. They're rarely sick, but we tend to have one or two religious exemptions per year, then a number of absences due to visitation (and technically, these SHOULD be excused absences due to court order), and a few mental health days. However, my son is heavily involved in things such as Peer Leaders, G&T programs and Robotics that often lead to trips off campus to participate in special events - those are counted as being in school, but excused absences per class. His Dad & stepmom have issues with that one.

I can say that, even with my laxity in allowing some mental health days, 30+ absences would appall me. Even more so if the child were not bringing in straight A's.

She is an A and B student with C in Science. But they also see a tutor during certain periods through after school prgram.

Is this something that he needs to pursue, even though they were excused. Can the school be forced to provide copies of the excuses to him?

Another question: Can my husband take the kids to doctors appt. without biomom knowing about them. She is CP with sole custody. If he already has and she finds out are there any legal repurcussions(spell?). It is not their regular physician. It would be for a second opinion that biomom refused to get.

What kind of surgery did the child have over spring break? Despite the fact that the surgery was over spring break its likely that some of the absences (if not most) were related to that.

The absences were excused, (well 34 out of 37 excused) therefore the reasons were good enough for the school. I can't see the issue being useful in a custody battle....particularly since the child appear to be doing well in school.

Has your husband considered discussing it with mom?

Not necessarilly. My kid had FOUR surgeries the first three years with us (two ear and two corrective eye surgeries) and the time involved for recovery, was REALLY minimal. About 48 hours before she could resume her normal schedule. So it really depends upon the nature of the surgery.

If mom in fact has sole custody, then the school is not going to provide him with any records, nor does he have the right to take the child to his own doctor.
