School giving excess punishment

My son and a freind of his were playing around at school. They were kicking each other and the teachers that wittnessed this state that the two were fighting.
These boys have been freinds for a while they stay at each others houses and go to church together. They were playing a kicking game between classes along with other students. We all know how boys can get ruff when they play.
I do agree that they should have gotten in trouble, they should not have been horse playing around in school, but this school gave them 3 days suspesion and a ticket for disorderly conduct.
We are now in the process of waiting to go to court in feb. of 06, because we pleaded not guilty o the citation.
Im getting a little worried about needing to get an attorney, because I feel like we are just going to be railroaded over this and my hands feel like they are tied.
Can you please advise in what I should do?
I dont think that it is fair that these boys have a disorderly conduct entry on their records for this.
 


You have to separate out the school's punishment and the court’s proceedings. The school’s punishment was the 3 days. The school referred it to the police, and the police charged your son. The court will deal with the disorderly conduct charge. The school cannot charge your son with a crime. If your son has no other criminal background; if both children were not hurt; and if both children stories are the same, I think it would be a waist of money to hire an attorney. The juvenile justice system has a lot of bigger fish to fry. Have him dress appropriately, look in the eye to the judge, and tell the truth.

Thanks for the advice.
I was leaning that way also, but I think that some of this anger i have towards this problem goes deeper than him just getting a ticket.
I feel that the schools today do not want to take any resposibility at all for our children. They just write tickets left and right, it seems like for everthing.
I feel like parents need to stand up and I dont know where to start.
I talked to the officer when this happened and he stated that he would not have written this citation to some one for this out in public but the school made him write it.He said if the school tells him to write a citation he has to . Im sure this is an agreement between the schools and the police. The officer is assigned to stay at the schools all day.
On that note , does the school have the right to make its own laws?
It seems to me that things are getting out of hand and a happy medium needs to be found.......

Of course, it would help the schools immensely if they didn't have to teach kids how to behave properly, but the parents took responsibility for that as they should. Doncha think?

Oh I agree with that immensely, beleive me my son knows right from wrong and does not get away with much.
But I beleive this started over the battle of discipline between the school and the parents, the school and the gov. took the ability of parents away from them to discipline thier children.
I used to get my butt tore up as a child until sometimes i could not sit down,With the switch from the yard that i had to go get myself, and Im know worse fot it.
Try that today and see what happens.
So I beleive some parents have given up and now we have little tyrants to deal with in the schools, but its not right for the schools to throw all children into one lump, know matter the child.
My son has never been in a fight or been in trouble like this, doesnt that count for something?
