What is the name of your state (only U.S. law)? colorado

my daughter was involved in a car accident going on a field trip with the school. my questions are, can the principal and councelor take children from school on an activity trip in their personal vehicle with out parents permission? and second can the school be responsibily for not providing supervised safe transportation?

please someone help my daughter was hurt in this accident the school is telling me they are not responsible for what happened.

Are you saying that you did not give permission for the field trip? Or are you saying you did not give permission for her to be taken in a car?


and second can the school be responsibily for not providing supervised safe transportation?
Since when is a car considered inherently unsafe transportation? Do you only transport your children in a school bus?

Did you sign something giving permission for your daughter to go on this trip?

Were you led to believe (in writing) that they would be using a bus?

Did you think your daughter was in school, but she was gone from the school without your knowledge?

How many other children went on this trip?

This all sounds rather...odd.

And are you saying that the volunteers here, who do this on their own time, should have dropped everything to answer your question? Sometimes you need to wait till people get home from work and finish dinner, for example.

And so what happened when you put in a claim with both the school's insurance company and the driver of the vehicle's insurance company?

Hopefully these are enough posts to suffice for your impatience. Now, should we rush you for answers to OUR questions?

Sorry everyone. they were to use school transportation and instead they dediced to take the councelors car to save gas because the school activitiy buses are to expensive on gas. i never gave permission for my daughter to be in any other vehicle besides school transportation. my daughter was in school on that day she went to her first hour class then they left after that for this field trip. there were 3 students and the principal and councelor. after the accident they did not notify us until 3 hours later that they were involved in a car accident.
they even had the school secretary pick up the kids from the scene in her personal vehicle.

You do realize that a car/personal vehicle is far more safer than a bus would be, there are no seat belts, they have a tendency to tip thus throwing everyone on board all around bringing up more injuries. I would choose a car over a bus, altho that whole minnesota bridge collapse thing was weird how no one in the bus was injured.

If the school district had a "School Car" would that have been okay? Is it just the fact that it's personal bothering you?

You should file a claim with the owner of the personal vehicle's insurance.

They never called an ambulance to the scene.and when they got back to the school my daughter complained of pain to her back and arm the principal told her to wait it out it could be normal pain. this accident happened on april 10.i took my daughter to the e.r. myself immidiatly. the school refused her medical attention.
then i find out the police report did not have any of the children or the principal on the report. i went to talk to superintendent and she never knew they used this other vehicle they thought it was school transportation they were in the whole time. they were told there were no injuries in this accident until school started receiving medical bills. not only from my daughter.
