The attorney you consult should be questioning both the legitimacy of the police stop and the legality of the vehicle search.

If the charge cannot be dismissed outright, and if this is your first offense, you should be eligible for a diversion program which includes probation and community service and will keep the criminal charge off your record if terms of the program are met to the satisfaction of the court.

He did the right thing deleting...and you all know my feeling about thread deleting. We should always tell minors to only talk to their attorney and to not post their criminal case on the net.

Other than the mention of what supposedly led to the stop, there was little said by Schwec that could lead to his identification. He is one of many many many in Wisconsin who are caught possessing marijuana.

But your advice for him to speak to an attorney was good advice.

There was a detail that made his situation potentially id-able. Regardless...children should not be posting about their criminal cases on the net. They should be warned to ONLY speak to their attorney.

Minors post to the forum with some frequency, especially in this section of the forum. They are naturally curious about the penalties they face when charged with a crime - with the crimes committed often possession of drugs or alcohol. There is nothing wrong with providing them with the laws involved and possible penalties.
