Screwed over....ARGH!

OK...So, back on March 11th, I purchased 2 sets of tickets to the Patriots (tickets that would be shipping in August - as they aren't printed and shipped until then). I have the item numbers of both sets of tickets. We purchased these through Ebay. At the time, the seller had a good reputation and he had good reference. I payed immediately via PayPal and the pmt went through on March 12th. The seller promised that these tickets would be sent in August. I intially emailed him on July 21st reminding him that we purchased the tickets from him back in March and when should we expect the tickets. He emailed back the same day saying that I should have them in about a month. I then wrote back and asked if he had my mailing address. He wrote back and told me to give it to him again. I wrote back again with the address. On August 15th, I wrote back to him and asked him if he had any word on the tickets and reminded him that it had been almost a month. He wrote back and said that he would have them out in 5-10 days. On September 2nd, I wrote and told him that I still hadn't received the tickets and to please advise. I never received a response to that email. On September 10th, I saw that he was online on Gmail Chat, so I decided to chat with him. I asked him about the tickets and when I should have them. He said that he should have them out soon. I asked when he thought that he'd have them. He said that he only had 4 now and was waiting on the other 4. I told him to ship the first four and I'd wait for the second. He shut off his chat and never responded to me. I sent him another email on September 18th telling him that I felt like I was being f-ed over and that I'd be getting a hold of ebay to get my money reimbursed to me. I told him that I'd like to see something more definitive than "they are in the mail" unless he could actually give me a tracking number. I never heard back on that email. On September 26th, I saw that he was online again and tried chatting with him. He never answered me. I sent him my last email today telling him that I'd like him to send me the tickets to me or to send back my money.

SO...last week Thursday, I contacted ebay spoke with someone on their live chat. They directed me to a link that I had to fill out a form on their contact jump page. I filled that out and was told that I'd have a response within 24-48 hours. I never heard back from them. On Tuesday, I contacted ebay again. This time, she told me that they had received the email but it was past the time limit, so they didn't send a response. She told me that I should send another email just to make sure that they had my information. She led me to a page where I had to go through all of these hoops to leave an email. After typing out my story once again, I clicked send and it deleted the whole thing and didn't send! ARGH...so I got back on live chat (for the 3rd time) to speak with someone who actually gave me a phone number of ebay (888.445.4992). I spoke with Gabi and she told me that I was out of the time frame for ebay (which is 60 days) and out of the PayPal time frame of 45 days! SO....she told me that she'd contact the seller to get a hold of me. Also, she told me to contact my financial institute and they would probably be able to help me. SOOOO....today, I called Bank of America and the lady I spoke with told me that I was out of their 60 day window as well! SOOOO....basically, I'm screwed! Anyway, she told me that I'd need to contact Ebay to get the seller's information to make a police report and then I could come back to them with the police report information. OK...so then I call Ebay and because of their privacy act, they cannot give me any information about the seller who has just screwed me over out of almost $600!!!! They told me that the only way I could get that information is to get a subpoena! How do I go about getting a subpoena? Is it likely that I'll ever get my money back. I don't want to do the small claims court route b/c I feel like it will be more in attourney/court fees than the $600 I paid for the tickets. What should I do???? I am SOOOO mad!!!!!

Ebay live help is world renowned for being completely useless. They frequently give out improper information. Nobody at ebay has EVER responded in two days.

Ebay forbids selling things that can't be shipped in 30 days for exactly this reason.

If you paypal'd the guy, you might still have contact info in your paypal transaction history (at least the guy's name and postal address).
