My younger brother recently came home from work to a empty house. His fiancee did not take anything that belonged to him but. He had co-signed a car loan for her but she did not put the bank as lien holder on the title when she had it transfered. The bank wants him to refinance the loan as a high interest (18%) unsecured loan.
Can they make him do that?

Also 2 weeks before she moved out she went to Rent Way and used his last name and a false SS# (her dead grandmothers) to rent $4000.00 worth of equipment and had it delivered to his house. She took the equipment when she left. Rent Way is threatening to sue him for the money. His name is not on the contract.
Can they sue him? Do they have a chance?

On a positive note!?! He has 10 video tapes of her with other men & women from when she and her ex-husband were together (they were into the swinging life). Her ex-husband has offered $1000 for copies of the tapes.
Can my brother get into legal trouble if he sells the tapes to her ex?

She cannot be found. We believe she moved to Nevada.

I'd suggest 2 things. First of all. he needs to go to the police and file a fraud report over the rental stuff. Her using his last name and a false ssn# is theft by deception. If all of this is true, he needs to give the rental center the copy of the police report and tell 'em if they bother him again, he'll sue them for harrassment.
Secondly, give the videos back to the ex. I would guess there are some privacy rights that the ex has in this mater {not to mention human decency} that would give him a strong claim.
As to the bank, if he cosigned, he's toast if she doesn't pay. He needs to check the contract for penalty or default rate provisions to see if they can make him do that. He needs to start turning over rocks to find her and get her arrested so he'll know where to at least find the car and get lender to repo it.

He (as well as Rent Way) has filed a police report and the police gave it to the prosecutor who told my brother "if she comes back to Indiana he will prosecute her".
If my brother gives the tapes to the ex he cannot get into trouble but if he sells the tapes to the ex he can? The ex made the offer to pay for them.
