i live in ohio,in a twp. a municipal court has jurisdiction. the sheriff dept. and state patrol have enforcement jurisdiction. i was served a search warrant that was wrote by the municipal court, but they issued it to the city police dept. to serve outside their jurisdiction. is this a valid warrant as in state v klemm 1987, or is it an invalid warrant rising to the level of being unconstitutional as in state v harrison {ohio com. pls. 1969}? if its unconstitutional can the warrant be argued before formal charges are filed?
