I was walking on a street around 1:40 am when a cop stopped me. He said there were prowlers about and he got my info and looked me up on his little computer. He then got out of his car and said he was going to frisk me and then told me to put my hands on his car. I did and he found a small amount of marijuana in my jacket pocket. I live in Minnesota, and my question is; If he stopped me about prowling, how could he write me a ticket for possesion of marijuana? The marijuana was in a small container about an inch by an inch by a centimeter, and that was in my pocket. Thank you..

An officer is allowed to stop and frisk someone if he has a "reasonable suspicion" that the person is engaging in criminal activity. His belief that there are prowlers around does not qualify. Also, they are only allowed to frisk for weapons or anything that could hold a weapon. Your little box could not hold a weapon. Unless you consented to the frisk, it sounds like an illegal stop and frisk to me. You should get a lawyer and challenge the search. The police can arrest you for anything they find in a legitimate search.
