i've been followed a lot lately while shopping for groceries by a particular employee of said establishment. i don't really care, i'm not doing anything wrong. i'm just wondering, if this would happen to escalate into his trying to detain me, or search my property am i within my legal right to refuse? what are the rules as to this kind of thing by non law enforcement personel? this guy isn't even loss prevention, he's a produce boy. if i would be compelled to submit to a search and am found to be in the right, do i have any recourse?

How disappointing. I was hoping for some hot "produce boy on boy" action.

But in any event, if said produce boy physically detains you and it turns out you did not commit a crime, you will have a lovely cause of action for false imprisonment and assault (and possibly battery with a cucumber, but that may just be the workings of my overactive imagination again).

Any employee of a store can lawfully detain you and use the minimum necessary force, except deadly force, if he reasonably believes you have stolen something.

The employee is acting as an agent of the owner.

It's justifiable under Title 18, Section 507.
