I live in a small town in Arizona. Today I was stopped by a Highway Patrolman, who stated that my window tint was too dark. He used his little machine and told me that it was 27%, so then I questioned him about the accuracy and he asked me if I would like for him to check it. Of course I said yes. He came back and showed me that it was 2% off. Then I asked him what about the dust or smoke on the glass, so he took his hand and brushed off the dust. He used his machine again and it was now 33%(33%+2%=35% limit in AZ, I think). He then asked me for my license. I gave it to him and he went to his car. He came back with a citation for not wearing my seatbelt, I tried to explain to him that I had removed it when I was pulled over so that I could get out of the car. He didn't listen to me and told me to sign here. I then asked him why he stopped me and he said because of the tint. I then rebutted and stated that it was within the limits and he said yes it is, so I asked him if he pulled me over for nothing then and he said, "basically yes". But I still got a ticket for no seatbelt!!!! Where do I stand??? IS this entrapment?? IS this a probable cause stop?? Thanks!
