What is the name of your state? GA

I owned stock in a small company that has since been delisted and is worthless as a result of fraudulent activity on the part of the ownership/upper management. The Dept of Justice indicted the CEO and COO and is currently involved in a case against them. In the event, they are found guilty, can I sue them to recoup the losses I incurred as a result of their illegal doings?

unfortunately, individual stock holders are generally WAY WAY WAY down the line in the list of creditors in order of payment. Chances are that you will be out your investment. You may however be able to use the loss as a tax deduction. Not much consolation huh?:(
