Section 8 has been paying me $600 a month for one of my rentals for the last 2.5 years. I put in a request for a slight increase in rent. I received a letter stating my request was declined. Section 8 called my tenant and told her to start looking for another place because my request was declined and landlords usually evict tenants when they are declined an increase.

3 weeks later I receive another letter stating my request for an increase is declined and in fact they are lowering it to $527 a month effective immediately.

What recourse do I have? How can they pay rent for over 2 years and then lower it? Please help me figure out what to do.

What recourse do you have? To not renew the lease, and start advertising for a non-Section 8 tenant.

When you agreed to participate in section 8 you agreed to there rules for management one of wich is that if the tenants income changes so can the portion of the rental contracted payments . So if they reduced the check to 527.00 your tenants next rental period they will owe you 73.00 on top of any other partial payment they make. Your telling the tenant to leave is a mistake, If your tenant doesnt pay up the difference every month as the contract they signed with s8 program would require they can be evicted for non payment. Many section 8 tenants do indeed make the payments required by the contracts they signed because they know how hard it can be to find a LL who will participate in s8 program. YOU do need to carefully review all your docs you signed when you agreed to participate in s8. EVERY rule they have is addressed inc telling you that if the tenant violates the lease that its up to you to take action. Make sure that you keep current on the repairs needed and everything should be all good when they do re inspect.
 
I happen to be on Housing and the portion of rent not paid by Housing is paid by me! If I fail to pay the eviction process can begin and i will lose my housing! When I moved in and then renewed lease I agreed to a certain sum as rent. I am responsible for any rent due after housing pays their portion. In fact it has not been uncommon for me to pay more than housing pays! Housing is not set up to pay your rent housing is to aid you in paying rent. They (housing) use a math dormula to figure out their (housings) portion of rent based on untilities you pay etc. If housing isnt pay full rent then the balance is owed by tenant
