Hello,, I was looking over a my hubbys new updated credit reports and noticed that Cavalry Portfolio Services has listed an old ATT wireless debt. Back in April/May they sent me a letter about the debt. I called them and disputed the debt and in return I got a letter telling me I had to prove to them I didnt owe the money. So I sent a dispute and validation letter to them, they recieve the letter on May 16th. I also enclosed my proof that we didnt owe the debt. I have not heard a word from these people, and today I saw what they had listed on my hubbys credit reports. They just listed this in July. Have they violated section 809 b of the FDCPA?

No where in my research do I come across where the CA can demand that you show PROOF of the alledged debt being owed. Stick with the debt validation letter followed by a cease and desist (IF!) its beyond the SOL.

If Calvary didn't send you notice that they were going to report negative information, then they have violated the FCRA. This is a new requirement under FACTA and it DOES include collection agencies.

Could Cavarly come back and say that the first notice they sent to me back in April was just that. I want to get these people for ignoring what I have sent them, and for putting this back on my hubby credit reports. Att had this listed on there but we disputed it and all three removed it cuz ATT couldnt even validate the debt. I have disputed it with the credit bureaus, so I will know in 30 days what Cavarly will tell them.
And Tayla,, I know I didnt have to prove to them I owed the debt,, but I had the proof that it wasnt owed so I was more than happy to send the information too them.
