dear sir and mam:
i have a friend that is having trouble getting her deposit back from this a-hole. she put down a total deposit of $1000.00 in order to hold a car for purchase from this person. all of this happen in september of 2001. the jerk not only sold the car to someone else but stated that he had to use my friend's money for maintenance and some other excuses. when she demanded her money back, he stated that he was having financial trouble and is will to pay her back in payments. she did not hear from him for more than two months. But she finally tracked him down in december 2001 and made him sign a hand written contract stated that he must pay her back the deposit in payments with a 10% interest. till this day, she has not seen a dime. She doesn't know if she should take him to small claims court. or get a lawyer to write a letter to this disease monkey stating that the lawyer would take him to court and make him pay the court fees, etc., if he doesn't pay back the deposit. i suggested the lawyer letter to her. but we would greatly appreciate your advise on what to do with this situation. please reply through my email address or call me at 626-252-6139.
