Security deposit dispute

What is the name of your state (only U.S. law)? California

We are in dispute with our previous landlord regarding the return of our security deposit. She did not return the deposit or an itemized statement within the legal time frame (21 days), did not provide receipts and is charging penalties that violate Civil Code Section 1950.5. We have sent her a demand letter requesting the additional $553.00 and have not deposited the $895.00 check she sent us. We are in a bit of a financial bind at the moment, and were wondering if cashing the check she has sent us would have an effect on our dispute? Would that be considered us "accepting" the amount sent? The check does not state "paid in full" or anything to that effect. So, are we safe to deposit the check? Will we still be able to pursue her for the additional funds? Thank you!
