I've rented an apartment on a month to month lease. I rented it in May of 07 and gave my 30 day notice in a written note and phone call to my landlord on March 1 and set the move out date on March 31, 2008. Well now my landlord is withholding a portion of my security deposit to clean the carpets saying I'm the one who must pay for it because it's dirty. I pointed out to him that at times when we went over there to clean he was there without our knowledge showing the apartment so we could only clean the bedrooms and just not the living room. Can he withhold that money even though I haven't lived there for a year and he had entered at least 3 times without my consent or knowledge before March 31st?


Aslo my apartment is like a duplex it's only two apartments. Mine's on top. He's aslo charging me for extra garbage. Now between the two households we have ONE trashcan. Now I know Waste Management doesn't charge if you put the extra bags beside the trash can but my landlord put out the extra trash can and said I have to pay an extra cost for it. Is that allowed?

Your LL did not need your consent to show the unit , your LL only needed to provide reasonable notice , If you were not living in the unit near the end It shouldnt matter that the unit was being shown, you could have said ` excuse me please` and kept cleaning any way. NOW about the carpet , if you left it dirty , yes it needed to be cleaned , leaving dirty carpet is not normal wear and tear. Is that allowed?< Did you get a bill from the trash collector showing no extra charge ? DO you have a copy of the trash haulers policy showing when additional charges appear ? Your LL may have put the extra can out to stop dogs from tearing open bags OR had a letter from the trash hauler telling him that over time extra bags had been set out side of the container incurring extra charges and requiring a second container. SO yes its fair to bill you for additional trash during move out. IF you think the charges are not fair then go to small claims court and ask for the money to be returned to you.
