Security Deposit Refund from Daycare Facility

I am considering pressing suit against my childs former daycare center. I removed my child from the center after 3 injuries she received in a six week period. There was an injury every other week. When I notified the center's Director that she would not be returning, I explained why. Before I could ask for my security deposit back, the Director immediately stated to me that my deposit would be returned. She also stated that it would take three to six weeks. So on or around the fifth week, I called her to find out the status of the deposit being returned and was told that it takes from six to eight weeks before I would receive. I brought to her attention that she told me it would take less time initially. She then stated that the least it would take is six weeks but the max is eight weeks. So on the eigth week, I called her to find out exactly when I would be receiving my deposit and she basically told me that she didn't know. The deposit was coming from a California office. I asked for the number to that office and she refused to give it to me. The contract stated that we are to give the center 2 weeks notice before removing your child from their care and that the security deposit would be applied against the childs last week of attendance. However, I removed my child because she sustained too many injuries in such a short period of time, the last one of which I had to rush her to the emergency room for. I believe that I am entitled to my deposit back. I also believe that is why the Center's Director volunteered before I could even ask for it. And now I feel like I am getting the run-a-round. It has been eight weeks and still no deposit. What are my options?

What did they say in response to your letter detailing your position???

Of course, you did write a letter and sent it certified RRR, didn't you???? After all, you can't be relying solely on verbal promises when this is so important to you!!!

Oh, I guess you forgot to write.... send them a letter NOW!!
In it, detail the injuries and the statements made (by name and date). Include the 'promise' of a refund within the timeframe noted. Finally, point out that the refund period has expired and you still don't have your refund. Demand that it be received within 7 days of receipt of your letter.

Then, if you don't get the refund, you have a documented demand letter to support you if you have to litigate. Also, it can document the injuries that your child sustained in the event of a personal injury claim.
