I am taking my former landlord to court for the return of my rental security deposit. She is counter suing for damages she says I caused. These are damages to the ceilings in two rooms due to her neglect to fix two leaking tub pipes. She is represented by a lawyer who is stating I told the landlord there was a flood in the bathroom which caused the damage. I do have dated pictures showing damage and letters written to her requesting the repair of these pipes. They were not notarized or sent certified mail. The cost to fix the damage is also excessive, as it includes replacement of all ceiling tiles, not only the ones that were damaged. What sort of things should I bring with me to court and what kind of witnesses would best help in my defense? What do you think are my chances of getting the return of my security deposit?

Your chances of getting an accurate answer would be much enhanced if you followed the directions on this site (see the RED text up at the top of the screen??? WHERE ARE YOU??)

However, my general answer would be that you probably have a good case if you have the letters you sent and the dated photos.

I suggest that you focus your claim to two things:
1) You are not liable for the bathroom damages since the landlord failed to make timely repairs and the damage occurred as a result of her failure. (Where did this 'flood' come from??? If it was a flood, or broken pipes or overflow, the landlords property insurance would apply.)

2) Challenge any 'estimates' of repairs that are not substantiated by 'independent' written estimates. Ask where they came from, etc.
