We have lived in a triplex for a year, and when we moved in, there were many things wrong with the place - dirty carpets, walls needed painting - many scrapes and marks, dirty cabinets etc... We had pictures taken and a copy was given to the landlord. None of the things were fixed.
When we moved out, the place was inspected by the landlord and we got billed for painting of the entire house, cleaning of all the carpets, new blinds, and everything else they could possibly bill us for. Landlord claims that we never gave them any pictures.
Also - the place was not rented after we moved out, and landlord is claiming that we are responsible for rent until the place gets rented since we kept it in a bad shape and landlord was unable to show the apartment.

If we take the landlord to court - does the landlord have to prove that we were responsible for the damage? or can he just claim that the place was perfect when we moved in and say that he never gotten any pictures from us? Can the landlord keep us responsible for the property not being rented?

We are getting ripped off, so any help woud be appreciated

He would have to prove to the courts satisfaction that damages were incurred and that you were the tenant at the time.

Of course he can claim that.... amongst other things. It is up to YOU to show YOUR pictures taken at move in.... and your WRITTEN condition report you did when you moved in.

Can the landlord keep us responsible for the property not being rented?
Depends. Were you at the end of your lease?? Or if a month to month, did you give at least 30 days WRITTEN notice??

It was a one year lease and we notified the landlord that we will not re-new at least 6 months prior to the end of it.
