Security deposit return

I am curious what recourse i might have for the delay in a security deposit being returned. I have hit the 45 day mark on the absence of my deposit check. I know this is the deadline here in Chicago. Does the failure to return the deposit mean they can no longer charge for damages? I am aware of a fee coming out of the deposit but do not know the amount.
