I am in desperate need of advice.
I was living in an apartment that I vacated early. In order to do this I showed the apartment myself, advertised it myself, etc. I procured a tenant that moved in on the 5th of the month, so there was a 4 day gap in time. During my final walk through I was told the apartment was left in immaculate condition and only minor touch up paint was needed. It is my understanding that they can't take money out of your security deposit for painting if it falls into the normal wear and tear of living. In addition to this, the management company raised the rent for the new tenant (but still wants to charge us for the 4 days we did not pay rent).
It is now past 21 calendar days and I have not received my security deposit back nor any letter of itemized deductions. What are my rights here? Can they legally take money out of our deposit for those things? Can I take them to small claims court and sue them for triple the deposit on the grounds of bad faith retention and the difference in rent that they are making from the new tenant?
