we recently moved and have been put off by our former landlord as to when he was going to our deposit back. first he told us that he spent it and if we waited until somebody else moved in he would give us half a month's rent back since we had moved out in the middle of the month. that was almost 2 months ago and in the mean he has said that things were damaged and that the the house stunk because of our dog. he said that he was going to a professional cleaner come in and clean the carpets. we paid him an extra $300.00 deposit so we could bring our dog into the house. we just talked to him and he now says that if they can't get the smell out that he was going to have to replace the carpets. when we moved my wife went back into the and steam cleaned the carpets where the had messed and we also went back into the house and examined it on 11/29 and there was no odor. the problem is my wife only got a receipt for the deposit(which we aren't sure where it is ) and now somebody has rented the house and they have a cat. are we screwed as far as getting our deposit back or do we have a way of getting it back. we live in northern n.y.
