Last July, I signed a 1 year lease with 4 other people to rent a house. The lease began in August and was suppose to go until July 31st 2006. There were many problems with the other tenants including them not paying their rent on time, and keeping the house in an unsanitary condition and causing damage to the property. After the electric being shut off for the second time, despite me paying my share of it, I moved out. When I went back 2 weeks later to move all my stuff out, the power was still off and the water had been shut off. I continued paying rent even though I had moved all my belongings out and no longer lived there. I talked to the realtor to try and get my name off the lease and he told me I dug myself in between a rock and hard place and had to deal with it. On the 28th of May he then then tells the other tenants that if they move all their stuff out of the house by the 1st, and pay half a months rent we can just mutually end the lease and he will rent it to someone else. They agree and also move out. I have heard nothing since then, and none of the tenants or realtor will answer or return my calls. I recently e-mailed the realtor to see what the deal with our security deposit was, because Florida law says that he has 15 days from the day the lease ends to either return the deposit or state what he is withholding from it. All he replied with was that they are in the process of fixing damages and getting the property ready to be rerented. It has been 49 days since they moved out. Should I consider taking this to small claims? Any help would be greatly appreciated!
