I live in Virginia and have rented a duplex for 15 years. I did not sign a lease when I moved in. Reason: Small town, everyone knows everyone, etc. I did pay a security deposit and have my canceled check. My landlord has sold the property. He told me he would transfer my security deposit to the new owner. He said if he gave it directly to me, then I would have to pay the new owner a security deposit based on the current rent. If he transfers the deposit, then I won't have to pay more money. The new owner said my security deposit was not transferred, but he is not asking me to pay him a new security deposit. Should my deposit have been included in the property sale? If not, how do I go about getting it back? Thanks.

NO the secruity deposit gets transfered at the closing, your new owner is wrong, That should have been explained to him at the closing!

If he didnt recieve paperwork at the closing, then he screwed up and you should not be held liable.

Tell the new owner he will have to sue the old owner to get the deposit, but it you move out he will still have to pay it to you, wether or not the old owner pays it to him.

By the way, he can evict you with a 30 day notice, so I would ask him for a 2 year signed lease before you get all huffy.
