I signed a lease a couple of weeks ago and then tried to back out. I could not, but I have found someone else to rent the apartment. The lessor has agreed to this and I am now relieved of the lease and rent. However, I want to know if the landlord can keep my security deposit. He did not advertise the apartment, other than a message on the answering machine of the apartment complex, and the new tenant is moving in before my lease was set to go into effect. How much should I be able to get back from my security deposit? All, some, or none??

well did the landlord lose even a days rent on you?

Since the tenant is moving in,on or before your start date of the lease, then you would be entitled to it all back.

The landlord cannot keep the two deposits. Write a letter send it certifed mail return reciept, and give the landlord 14 days to refund all of your deposit if not, then you will have to learn about our legal system by suing him in small claims court.
