I'm moving out of my apt in NYC at the end of Feb. My roommate and I don't want to pay our last month's rent and instead want the security deposit to be used b/c as our landlord is HORRIBLE, we know he will not give us our security deposit back despite the fact that we are leaving the apt in the exact condition as when we moved in. What recourse does the landlord have if we don't pay Feb rent and assume he'll use our security deposit in lieu of that? We are both moving out of state. Does that make a difference to his course of action?

well if you are giving up a rent stabilzed apartment.....

then you are IDIOTS!

that is the game to be a horrible landlord, have tenants leave and jack up the rent 20% everytime there is a vacancy.

Well he will sue you in housing court, and you will have to come back to court anyway.....And You can use the last months only if the landlord agrees..

Take lots of pictures, and a video, especially when he is there doing a final walk thru to verify any damage, send ALL letters certified mail return reciept that should intimidate him.

And be prepared to come back to sue him in small claims court.
