I rented an illegal basement apartment in the state of New York for just over a year. About a week ago the hose on the landlord washing machine broke and flooded my living room rug and furniture about 1/2inch of water. We discussed the possibility of prorateing the rent due to the fact that the rugs had to be pulled and I was unable to use 1/2 the apartment for 1 week. The landlord then decided that the rent was not going to be prorated and when I informed them that I would then be moving out the next day I was told that they were going to keep my security deposit of 1 months rent because of some minor nicks in the wall and a dent on the door from my furniture when I moved in. We had agreed a day before that I would repair the damages myself and my security would be returned and the next day was told they were keeping it. I have a written agreement that my security would be returned if given 30days notice of moving out and only normal wear and tear of the apartment. I did not give them the 30days due to the flood and uncomfortable living conditions. Can I do anything legally about this to get my security back?
