I am wanting to know if I can bring action against Members of my family for causing Emotional and Mental Duress. Due to their actions, I have had to start seeing a therapist as well as begin Anti-Depression and Anti-Psychotic medications. They have falsely accused me of several crimes ranging from neglect, to theft, to forgery pertaining to my mother whom I was giving care for..

Usually emotional and mental duress themselves are not actionable, except in limited circumstances. You might want to consult with a local attorney, who can review all of the facts of your case and advise you accordingly.

Ha, ha, ha. I was just gonna ask if they were some long lost relative of mine! My idiot brother tried the same thing. Relax, figure out how to be one step ahead & know what's in your heart regarding caring for your mother and take all the comfort you can from that. Good luck!

Yes, you can sue. Anyone who can't find a cause of action against family members isn't spending any time with them.

A better question is *should* you? The road is very hard and if you're lucky, at the end of it, you will get in front of a judge or jury WHO HAVE A FAMILY OF THEIR OWN. Most everyone has a family member they'd like to sue. (Or, at least they dream of it just before taking the car to the shop. You know, the one with a dent from dumba$$ brother-in-law just after he said, "Hey everyone look at me!") Think of the court system if we all did. The actions of the family would have to be beyond the pale for anyone to listen for more than a moment.

Also, unless we're talking about sexual abuse, most states will have a statute of limitations of only a few years. You will have to prove the actions which caused your problems happened during that time. That is, a doctor will have to come in to link your mental issues to actions taken by the family member (within the statute). Since we know so little about the brain/mind, that's not going to happen unless there was an incredible single incident which your problems can be linked to.

Finally, once the suing starts, the first thing defendants do is look back at the plaintiff to see if they can sue him for something. Using the same criteria you want to use on them, do they have a case?

Not to mention that the OP's insanity clearly has nothing to do with her family (they made her psychotic? Please). Let's try to keep the frivilous suits down to the bare minimum.
