What is the name of your state (only U.S. law)? NM
I have proof that my ex husband and myself had agreed thru the court that we were not paying either child support or alimony to each other but now I got subpoenaed for child support since they had applied for assitance thru human services dept in 2004. Would I still have to pay?
Short answer: Yes.

Why should the taxpayer be responsible for supporting your children?

The agreement was between Op and the hubby, not the OP and the State. Since the State was not a party to that agreement, and the tax payers are footing the bill for the OP's kids, the State needs to be paid back.
