British colombia / canada. i'am the landlord of a small commercial building, one of my tennants runs a Deli/pissa takeout bussiness. he's at he end of his 2nd year on a 3 year contract he paid first/last , security deposit upon sighning. the contract has a clause which allows him to give 3 months written notice should he wish to vacate the premises prior to his contract expireing. March 1 he gave his notice to vacate the premises by june 1st, his rent had been in arrears since january, in his letter he included payment till febuary 15, and deducted his damage/ security/ and last months rent. in his effort to bring his account up to date. it's now april and although he has been trying to find a buyer, has yet to pay aprils rent. my question is...am i entitled to have the locks changed and effevtively seize his assests till such time he can pay his rent or can i assume there mine, and just re-rent the premises with the equipement. i currently have a interested party wishing to rent the premises as is.
