Can a landlord evict a tenant and force them to leave without using the judicial process in my state?
I read the Mississippi Code 89-7-29 and 89-7-31 and it was my understanding that in order to make an eviction legal, a landlord must affirm, under oath, the facts regarding the tenants breach of the lease. The affidavit would be created and a summons then issued. The hearing would take place and if a judgement was rendered in favor of the landlord, the authorities would have to proceed in evicting the tenant.
Others (not attorneys) are telling me that self-help evictions in Mississippi are legal if the following circumstances are met:
1. A statement is included in the lease agreement that the landlord reserves the right to a self-help eviction
2. a 30-day notice is provided
3. The eviction does not breach the peace.
Can anyone clarify? I have read so many conflicting pieces of information.
