If the only evidence is heresay of self incrimination, should we pursue an appeal of expulsion for our 15 year old in Public High School.

She was questioned by a SHeriff's Deputy and subsequently by the vice-principal regarding a pocket knife that was found on the school grounds.

She had found it in the school bathroom, put it in her purse, and then took it out and left it on the steps a short distance away.

She has been expelled for a year. When asked if she put the knife there, she said she did to the Sheriff's Deputy. She was not Mirandized nor given the opportunity to call her parents prior to questioning.

Thank you.

"When asked if she put the knife there, she said she did to the Sheriff's Deputy."
*** She should be commended for her honesty.

"She was not Mirandized"
*** Not applicable as she was being questioned as to a violation of school policy and not criminal violation.

"nor given the opportunity to call her parents prior to questioning."
*** Again, not required.
