I am posting this for a client who accepted and deposited a check from a buyer on a horse($3900). Buyer was to pick up the horse late last week. Border crossing papers were not ready on the horse, and seller said she would notify buyer when they were. Buyer showed up Monday morning (unnanounced)and demanded horse. Seller told them the horses traveling paperwork was not ready, and here is your money back....due to them being pushy and not listening. The buyer had renigged on some other details of the purchase and the seller had had enough. Buyer blew up and is now threatening to sue. No contract was signed and they have their money back. Do they have a case against the seller?

Potentially. From the facts given, it appears that the seller breached the sales contract, so if the buyer can show and prove damages due to the breach, then perhaps the buyer could recover those damages. Alternatively, the buyer could potentially sue for "specific performance," basically requiring the seller to sell the buyer the horse for the agreed-on price. As to whether the buyer will sue or not, who knows, and as to whether or not the buyer would win, well, that would depend on ALL of the facts of the situation.
