Last January an ice dam occurred on our roof for the first time in the nine years since I built the home. This resulted in extremely minor water damage in the kitchen. I was going to paint anyway so it was no big deal. A roofer stated that there was nothing wrong with the roof; just the right combination of weather circumstances caused the ice dam to form and there is no good way to prevent it. When I put my house up for
sale in June, I asked my Realtor if I should disclose that this ice dam happened. Her reply was No. She said that since this was such a rare circumstance and that the disclosure form does not explicitly ask about this kind of thing that I had no compulsion to disclose. Do you think she is right? What is my liability should the eventual buyer experience an ice dam in the future? I live in Indiana.
