I purchased a motor for a Jet Ski from a company in Indiana. I needed to send the company my blown motor then he told me the amount, rebuilt the motor, then called to request payment. I overnighted payment to him certified (he signed for the check $1575). I then set up delivery for the next day for him to send me back the rebuilt motor (this was agreed upon by him). UPS went to pick up the package and was told the package was picked up earlier in the day by another driver. Now the it is almost a week since payment was received and he has not shipped out the motor and he will not return phone calls. Do I have any legal standing on this? I am so sick to my stomach...

First you say you bought the motor from a COMPANY.
Then you say HE told you the amount, rebuilt the motor and called you to ask for payment. So, are you dealing with a company or an individual?

If he (or the company) was smart, the motor didn't ship until your check cleared. With some banks, that can take two or three days. With some, it can take longer. I can almost bet that if you said he (or the company) agreed to send the motor before the check cleared in a court of law, there would be a prompt denial.

And it's not quite correct to say you bought a motor as if you bought a brand new one. What you did was to have your blown one rebuilt, which to me is taking a big, big chance. I'm assuming you did a whole lot of checking before you gave the guy (or company) your business.

Yeah I goofed...

We sent him a certified money order so there did not need to be time for the check to be cleared. It is a "one man" company from what I can tell. Originally he had a rebuilt motor, however once he received ours he said he had sold the other motor so needed to rebuild ours.

We did do some research. But, apparently not enough. Do I have a legal leg to stand on? He is not returning phone calls and our motor is in Indiana.
