We are located in California. My seller is scheduled to close escrow on 5/30/11. Per the purchase contract my seller is to deliver the property vacant to the buyer's at 5:00 PM on the close of escrow date. The property is tenant occupied & the tenant has advised us that she will not vacate the property by close of escrow. What liability, if any, will my seller have to the buyers if she does not deliver the property vacant to the buyers?
