We purchased a 4 year old house last December (2017). The first time it rained, this past May (2018), the roof leaked (rain is seasonal in Florida). We called the builder to see if the roof was still under warranty. It was not. He gave us the name of the roofer and when we called them, they said they had given a quote that August (2017) to the seller. The repair was not made with that roofer, however attempts to repair the roof were made as there is evidence of multiple attempts to fix the leaks (several colors of foam on a roof that was originally nailed down). During the inspection, nothing was indicated as to any issues with the roof. On the disclosure form the sellers answered two questions regarding the roof: Is the roof free of leaks - YES. Has the roof ever leaked: NO. They clearly lied, at least about the 2nd question. The problem is that we have had a roofer come out and they have made several attempts to repair the roof. Every time we all think it's fine, it rains and it leaks again. This is clearly a chronic problem and may be the reason they sold the house. Another issue is the roof tile is no longer available. Even if we get to a point where we are able to finally repair the roof, without the same tile, our million dollar home looks like a hot mess with mismatched roof tile. What is the next step to take? Do we go after the seller for a whole new roof? Our realtor contacted them and they ignored the letter. The live close by and are still friends with our neighbors. No neighbor has been willing to tell us they had a problem with the roof, I understand why they would want to stay out of it. Finally, one neighbor let me know they had been dealing with the roof for months. Just trying to figure out where to go fro here... Thank you in advance.
