We had our offer accepted by the seller four months ago, and since that time we have been being stalled on closing on the property. We were rushed to make application, The bank was given only 10 days to render a decision on our application, which they were able to do. We have met all of our obligations to this contract within the time frames that the seller set.
The Seller has had the responsibility to have the failing septic system upgraded to the states standard and is now dragging her feet on the process because she wants us to withdraw. First of all, we and our attorney were mislead as to how far the process had gone, and were basically tricked into signing a unreasonable purchase and sale agreement. Now after 2 months from signing and four extensions we found out that crucial information was withheld from the application to the state for the approval of the intended septic system. The state has requested the missing information from the seller, but as yet it has not been supplied. Our bank will not allow us to close until the septic plan has been approved and our mortgage commitment is now running out.
We are very upset that we were rushed into meeting all of our obligations, and the seller is able to drag her feet and possibly jeopardize our motgage commitment by not fulfilling her obligations in a timely manner. Is there anything we can do to make the seller meet her obligations with out incurring a large expense?
