i entered to purchase a coop and agreed on a selling price of 75,000.00 within 7 business days as stipulated in the sales contract I applied for mortgage of said property by putting 30% down and financing the rest...the bank subsequently turned down my financing due to the fact the property did not qualify after the appraisal...in other words...after the bank appraised the property....they felt that the property was not worth that much...therefore denying me the loan....I wanted to get out of the deal unless the seller was willing to come down on the price...seller refused...and is not willing to return my money of 7,500.00 i put down on escrow....they want me to pay for the 3 months of maintainence fees that they lost...WHAT!!!! that's right...they have some ****ing nerve...it is not my fault that i didn;t get the financing..now they want to keep my money.....their attorney is the escrowee...doesn't she have a moral obligation to return my funds...??? my attorney advised me that in order for me to get the money...seller must sign an agreement to release money..that is bull....my attorney is not working hard to get my money back..because...i believe she is not getting a fee for this transaction....please advise...what i should do...please.....!!!!
