i am in virginia, seller refuses to sign the termination release agreement, they defaulted on contract, they are afraid that the contractor might put a lien on the house for repairs done, the contract says the contractor only have 90 days to put a mechanics lien on it

once the 90 days have past does the seller have legal rights to refuse signing if not, what do we do to get our deposit back?

can seller keep our money or give it to contractor?
if lien can no longer be put on house seller has nothing to lose and no involvement between contractor and us.
