I made an offer to purchase a home in Arkansas. The listing and selling agents work for the same broker. The selling couple is divorcing. The selling agent phoned the lister as we wrote up the contract to ask when it would be presented. The lister presented the following morning and phoned to say "they" refused my offer but countered with another offer. I accepted and signed. The two agents discussed the refusal and counter via phone. The wife signed the contract. Today the husband returned from out of town and refused to sign. The listing agent represented the contract as complete to both the selling agent and to me. It never occurred to me that the husband had not signed. For all I know the wife has power of attorney. Do I have a contract at all? Verbal contract? Implied contract? And what about the listing agent's and/or wife's misrepresentation? What is the agent's or broker's liability? Do I have any recourse?
