What is the name of your state? Florida.

Hi. I wondered if anyone could shed some light on this situation. I called a store yesterday in Maryland, (I,m in Fla) about a guitar for sale. After speaking to two people, I was eventually transferred to an employee who told me it was for sale and the price. I then bought the said guitar, paying with my credit card. The employee told me he would go and process the payment and the item would be shipped the next day.

Today, the manager has refused to honor the deal. He told me his employee should not have offered the instrument for sale. I have been told that I can possibly still argue my case for the original sale.

Is this correct?

**A: why not? What was the exact reason? Was there as ad that you saw in the newspaper or website? Was the instrument NOT on or for sale?

He had it for sale on E Bay and therefore he said was not for sale to the public. However, it was hanging in his store at the time with a pricetag on it. Had I been there in person with cash, I could have walked out with the instrument as the salesman told me it was for sale.

A contract does not have to be honored or enforced if there is a material "mistake". The employee made a mistake, therefore the owner is not bound to complete the sale. Of course, he cannot keep your $$$ either. Has the charge shown up on your CC?
