Seller want to get my Earnest Money

What is the name of your state (only U.S. law)? :confused: MD

I have used this site several times and have always gotten true and honest assistance from the lawyers. With that said here's my new dilemma. I saw a home It was very nice "Sold as is". It so happens that it rained here 3 days strait, I went to inspection on Friday the 13th and the attic was leaking (my inspector stated, took pics and I saw myself). The seller wrote up an addendum of things they would fix to the roof. I hired a private roofer to take a closer look on Sat the 14th. The home was built in 1986, and all that had been done was 4 to five layers of patch work on the roof. (it was original roof). I signed addendum on the 13th of Nov of things to fix, however the selling agent did not sign it and send it back to my Realtor to this day. I canceled contract on Monday the 16th after my private roofer mentioned that this home needed a new roof. Now the selling agent wants to keep my earnest money because she says I breached the contract. I agree the home was sold as is so why did the seller offer to spend 1300.00 more to fix the roof. It is now in the selling broker and buying brokers hands. I don't understand what happens now.

If the proper steps that are spelled out in the contract are used to terminate the contract, you should be entitled to a return of your earnest money. If you didn't follow the proper steps, you are in breach.
