I am an online precious jewelry seller. I sold an item approximately 6 months ago. Within a few weeks the buyer notified me that the item broke. I have to say, I have never seen this type of damage on any of my items. I chucked it up to a freak accident and replaced the item, as I wanted to be sure that this situation does not repeat itself. I repeat, I did not fix the item, I send the buyer a brand new item. Now, several months later, I get an email telling me that the item is once again broken (no specifics or pictures as to the type of the damage). This time the buyer does not want it fixed, he just wants a full refund. This goes against the return policy that my online store has. In addition, I cannot agree to issue a refund without viewing the item. My warranty covers normal wear and manufacturing flaws. I really doubt that this is the case in this instance.
The buyer has threatened to file a small claims case against my store in Minnesota. I truly believe that this individual has come into some hard times financially and is trying to force me to agree to a refund (which is against our store policy which is stated online) without seeing the item.
Can I be held responsible in Minnesota for this? What sort of liability am I looking at? Would I be required to travel to Minnesota to defend myself?
