I have seen a couple websites offering to sell 'backup' cds. I was wondering if this was legal to do.

You are only allowed to make a backup copy if you own that product. You might see warez offering a single cd filled with full verison software. It is breaking the US law. That was why Business Software Alliance (stolen trademark from Boy Scouts of America - BSA) sent GESTOPA after people.
