I have a van for sale. I advertised it in the local paper and received several calls. One came from a lady who wanted to purchase it for her husband as an anniversary present. They came and looked at it, drove it and decided they wanted it on May 18. She requested that I only speak to her when it came to "money matters" because she was going to pay for it independantly of her spouse. I complied. She agreed to purchase the van for $4500. She wrote me a personal check that day for the full amount. She explained that she needed to get her money affairs together and asked me to hold the check "in good faith" that she will come back on May 22 with cash in full and will exchange it for the check and pick up the van. She wrote a statement saying that she agrees to purchase the van for $4500 and will be by on May 22 before noon to pay cash. It also says she will leave the check on May 18th in good faith and will exchange the check for the cash. Needless to say, she did not show. She called that afternoon and said she had a family emergency and could not come to pick up the van. But she still wanted it so she would Western Union us $500 and she did. We kept in contact with her over a few days (but I was out of town.) A few days later she Western Unioned another $500 even though we told her that it was too expensive for her to send money that way. I mentioned other ways that may be cheaper but she said she would be by on May 27th to pay for the van in full and she would not need to send anymore money. She did not show. The following Wednesday she called and said that she would send more money. I told her that I just wanted her to come get the van. I was NEVER under the impression that she did not have any money or she would be making payments to me. When all was said and done it turns out that she did not have the full amount of money and was not able to buy it. In the meantime I turned away 4 potential buyers telling them that the van had been sold. She now wants her $1000 back that she has paid into it. She backed out on a written agreement and I do not feel obligated to return this money. All I have now is a check that may or may not be any good and the written agreement. I am also out expenses for putting the ad back in the paper and another months car insurance that I would not have to pay if she had followed through. I told her that I had resold the van to any of the people who had shown interest ( I kept their numbers) that I would try to return some of her money out of campassion of her family emergency. She is angry and has threatned us with a law suit. What is the law in Illionois say about private party sales?
