Reside in New York State and have a separation agreement that was signed and notorized over a year ago. I recently filed with the County Clerks Office however Family Court states that I can not file a petition for violations of agreement and support since it is only a separation agreement. What can I do at this time to protect myself and my children?

My response:

File a Petition for Divorce. That's the only way the court will be able to have jurisdiction over your marriage, and then to make final orders concerning all matters; not just the children.
